California Living Trust

Probate Avoidance & Privacy: A properly funded living trust is a crucial component of effective estate planning, as it helps avoid the court-supervised probate process, which can be expensive (4% on the first $100,000, 3% on the next $100,000, and 2% on the next $800,000 of the estate's value). Unlike wills, the details of a trust remain private, providing an added layer of confidentiality for your assets.

Control and Flexibility: As the creator (grantor/settlor) and initial trustee of the living trust, you retain full control over your assets while you are alive. The trust can be amended or revoked at any time, giving you the flexibility to adapt to changing circumstances.

Incapacity Planning: One of the key advantages of establishing a living trust is that a successor trustee can manage your affairs immediately if you become incapacitated, thus avoiding the need for a court-ordered conservatorship.

Funding is Essential: Simply creating the trust document is only part of the estate planning process; you must also "fund" the trust by formally transferring titles of your assets (e.g., re-titling a home) into the name of the trust.

When It’s Recommended: Establishing a living trust is highly recommended in California if you own real estate or have total assets exceeding the 2025 small estate threshold of $208,850.

Community Property Advantages: For married couples, a joint revocable living trust in California can provide significant tax advantages, such as a full step-up in basis for both halves of community property upon the first spouse's death.

Steps to Establish a Living Trust in California

1. Identify Assets and Beneficiaries: List your assets and decide who will inherit them.

2. Choose a Successor Trustee: Nominate someone to manage the trust after your death or incapacity.

3. Draft the Trust Document: Utilize an estate planning attorney to ensure compliance with California law.

4. Sign and Notarize: Sign the document in front of a notary public.

5. Fund the Trust: Re-title assets (deeds, bank accounts, etc.) from your name to the name of the trust.

While a living trust acts as a "super will" for asset distribution, it is still advisable to have a "pour-over will" to capture any assets that were not transferred to the trust before your death.
